1. Agreement to Terms

By accessing and using DoneMode (the "Service"), operated by DoneMode Ltd, a company registered in Ireland ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, customers, merchants, contributors of content, or other users of the Service.

2. Description of Service

DoneMode is an AI-powered coaching platform designed to help individuals set goals, create action plans, and receive personalized coaching to improve productivity and achieve their objectives. The Service includes:

• AI-assisted goal creation and management
• Personalized action planning
• AI coaching conversations with multiple persona options (Direct, Supportive, Analytical, Creative)
• Progress tracking and accountability features
• Memory storage for personalized experiences (with automated memory extraction)
• Goal completion celebrations and progress gamification
• 14-day free trial for new users

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years old to use our Service. If you are under 18, you may not use the Service. By using the Service, you represent and warrant that you are at least 18 years old.

3.2 Account Information

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3.3 Business Users

If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Acceptable Use

4.1 Permitted Use

You may use our Service for lawful purposes only and in accordance with these Terms. You agree to use the Service for personal productivity and goal achievement purposes.

4.2 Prohibited Activities

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Share content that is harmful, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated scripts, bots, or other automated means to access the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with third parties

5. Usage Limits and Fair Use Policy

5.1 AI Conversation Limits

To ensure fair access and service quality for all users, we implement the following usage limits:

• Trial Users: 25 AI conversations per day during your 14-day free trial
• Paid Users: 150 AI conversations per day
• Rate Limiting: Maximum 30 messages per 15-minute period to prevent system abuse

These limits are designed to accommodate normal usage patterns while preventing abuse. If you consistently reach these limits and have legitimate business needs for higher usage, please contact us at hi@donemode.com to discuss custom arrangements.

5.2 Account Registration Limits

To prevent abuse of our free trial system, we limit trial account creation to a maximum of 3 accounts per IP address within a 30-day period. If you need additional accounts for legitimate purposes (such as team usage), please contact our support team.

5.3 Fair Use Policy

Our usage limits are implemented in good faith to ensure service availability for all users. Attempts to circumvent these limits through multiple accounts, automated access, or other means may result in account suspension or termination. We reserve the right to adjust limits based on system capacity and usage patterns.

6. Subscription and Payment Terms

6.1 Subscription Plans

We offer various subscription plans with different features and pricing. Current pricing and plan details are available on our website. We reserve the right to modify our pricing and plans with reasonable notice.

6.2 Payment Processing

Payments are processed through our third-party payment processor, LemonSqueezy. By providing payment information, you agree to their terms of service and privacy policy. We do not store your payment card details.

6.3 Billing and Renewals

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings or by contacting us.

6.4 Free Trial and Refunds

We offer a 14-day free trial for new users with full access to all features. No credit card is required to start your trial. After the trial period, you must upgrade to a paid subscription to continue using the Service. Refunds may be available at our discretion and in accordance with applicable consumer protection laws. If you're dissatisfied with the Service, please contact us at hi@donemode.com and we'll review refund requests in line with consumer rights.

7. AI Services and Content

7.1 AI-Generated Content

Our Service uses artificial intelligence to provide coaching advice and generate content. AI-generated content is for informational and motivational purposes only and should not be considered professional advice. You are responsible for evaluating and implementing any suggestions provided by our AI systems.

7.2 Third-Party AI Services

We use OpenAI's services to power our AI features. Your interactions with our AI are subject to OpenAI's usage policies and terms of service. Content may be processed according to their privacy policy.

8. User Content and Data

8.1 Your Content

You retain ownership of all content you submit to the Service, including goals, journal entries, and other personal information. By using our Service, you grant us a limited license to process and store your content as necessary to provide the Service.

8.2 Data Protection

We are committed to protecting your personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR.

9. Intellectual Property Rights

9.1 Our Rights

The Service and its original content, features, and functionality are owned by DoneMode Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal use in accordance with these Terms.

13.2 AI Content Disclaimer

AI-generated content is not a substitute for professional advice. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content. You use such content at your own risk.

13.3 Limitation of Liability

To the maximum extent permitted by law, DoneMode Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

14. Indemnification

You agree to defend, indemnify, and hold harmless DoneMode Ltd, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved in the courts of Ireland.

15.3 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable consumer protection laws.

16. International Use

The Service is controlled and operated from Ireland. We make no representations that the Service is appropriate or available for use in other locations. If you access the Service from other locations, you are responsible for compliance with applicable local laws.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and DoneMode Ltd regarding the use of the Service.
